A man who armed himself with two guns after losing a fight at a strip club has been convicted.
Police intercepted the vehicle that Jason Ferguson was traveling in near St. Barnabas Church and seized an Austria-Glock-21 and an Austria Glock-30 S with 31 live rounds of ammunition on August 24, 2018.
The firearms were found in plain view on the center console of the Chevy Cruze that was driven by Ferguson’s co-defendant Herbert Mackey.
According to the evidence at trial, after Ferguson got into a fight at Charms in Palmdale he asked Mackey to take him to his home at Woods Alley.
Ferguson allegedly returned to the vehicle with the two .45 pistols. One of the pistols had an extended clip.
They were headed back to the club when they encountered the police, the court heard.
Mackey led officers on a high-speed chase that ended at the juncture of Wulff Road and Blue Hill Road.
After seizing the guns, the officers searched the accused and found a magazine containing eight rounds of ammunition.
Ferguson exercised his right to remain silent at his trial before Magistrate Samuel McKinney and called no witnesses.
McKinney convicted Ferguson of two counts of possession of an unlicensed firearm. The magistrate acquitted Ferguson of the charge of possession of ammunition with intent to supply and convicted him of the lesser offense of simple possession.
McKinney also acquitted Ferguson of possession of a component part of a firearm and possession of ammunition in respect to the magazine that the officers allegedly found on him.
McKinney said officers were unable to identify the magazine and the eight rounds of ammunition during the trial.
McKinney remanded Ferguson to prison and will sentence him on Friday.
The magistrate delivered the decision in the absence of Ferguson’s lawyer, Roger Gomez Jr.
The decision was completed since March 2020; however, Ferguson had sent in multiple sick slips excusing him from attending court.
Ferguson’s co-accused was not present yesterday as he had sent in a sick slip.
Mackey’s decision is scheduled for March 4.
