Action will be taken against officers for not wearing masks

Police officers who flout regulations regarding the wearing of face masks, could be penalised.

Police Commissioner Atlee Rodney hinted at this on Friday during a press conference when he said: “I hope it doesn’t reach the point where we will have to take action against our own officers, but that’s just the reality of it.”

There have been increasing reports from members of the public that some officers are not wearing masks while on duty – and those reports have led some to question if officers are exempt from the regulations.

In fact, images of uniformed officers without masks have been circulated on social media. One social media post claimed that one of the officers blatantly refused to put on a mask.

Rodney used the opportunity to urge officers to set an example.

“We will continue to adhere to the protocols that has been established by the Ministry of Health, and I will take this opportunity to, even in this forum, appeal to my officers to be an example,” he encouraged.

The top cop added that one positive test result could result in the shut down of the police force.

“We can see what this pandemic normally does, and if we have a situation where a police officer that worked in a very congested area tests positive it will affect our operation…we had an incident in the earlies where a member of the band was infected, and you could see the implications it had on members of the band,” he remarked.

The Commissioner therefore reiterated the force’s commitment to adhering to the protocols, given the continued threat posed by the virus both locally and worldwide.

“It is something that we are very much mindful of and we will continue to remind them because we know the seriousness of this pandemic, we can see the effect that it is having,” he remarked.

Meanwhile, in the same press conference, it was announced that members of the public who fail to wear masks, as well as those found participating in illegal social gatherings, will now be ticketed $500 by the police.

An amendment was made to the Official Gazette on August 27, 2020.

A human rights group is warning of “disastrous” consequences if there is a departure from the centuries-old system of communal land ownership on Barbuda, despite a recent Privy Council ruling paving the way for such.

The entity speaking out is the Global Legal Action Network (GLAN), which describes itself as a non-profit organisation striving for innovative legal actions across borders to challenge powerful actors involved in human rights violations and systemic injustice by working with affected communities.

On June 13, the Privy Council – the country’s final court of appeal – dismissed a challenge to the Paradise Found Act 2015, which sought to circumvent traditional communal land rights on the island to allow the eponymous resort development to go ahead.

GLAN contends that the Privy Council failed to address a legally recognised land tenure system that had existed since slavery and instead found that Barbudans’ land rights are limited to a right to apply for a grant of exclusive occupation or for grazing animals; whereas only exclusive proprietary rights and the rights of the Crown are protected under the constitution.

“Despite the recognition of ancestral and communal relationships with the land, the Privy Council adopted a Western-centric understanding of property that does not reflect the historical, social and cultural specificity of the island.

“The decision reinforces the idea that colonialism has never really ended on Barbuda, and that Barbudans are merely guests on the Crown’s land,” GLAN legal advisor on land rights Dr Tomaso Ferrando said.

Meanwhile, legal officer with GLAN Jasmine Rayée described the Privy Council’s ruling as “devastating” for Barbudans, with “potentially disastrous consequences” for the ecology of the sister isle.

“The Privy Council failed to recognise the importance of Barbudans collectively acting as stewards for their island, prioritising instead the interests of the central government in Antigua and foreign luxury tourism developers,” she said.

“This endangers the fragile ecology of this low-lying island in times of a heightened global climate crisis; US-based developers are already destroying mangrove vegetation and natural dunes on the coast within an internationally listed wetland,” she claimed, referring to areas protected under global treaty the Ramsar Convention.

In a press statement yesterday, GLAN said the Privy Council ruling opens the door for “further exploitation” of Barbuda by luxury developers.

The GLAN release came the same day that Cabinet spokesperson and Information Minister Melford Nicholas reassured Barbudans that there would be “no capricious selling off of the land in Barbuda”.

He explained that there will be a process of survey, mapping and demarcation of land on the sister isle that will form a composite land registry.

Nicholas said the government will adopt parts of a plan that was submitted at least five years ago and seeks to partition the island into six distinct areas to include housing, tourism, agriculture and a national park.

He also expressed the government’s happiness that the legal proceedings concerning the land matter have come to an end.

The minister also chided leader of the United Progressive Party Harold Lovell and Barbuda Member of Parliament Trevor Walker for giving the people of the sister island what he claimed was “false hope” that there are further avenues to be explored in the long-running land battle, instead of moving forward “in harmony”.

Unvaccinated people travelling to Antigua and Barbuda will continue to have to present a negative Covid-19 test result upon entry.

Information Minister Melford Nicholas reiterated the Cabinet’s stance on Thursday in response to a question at the post-Cabinet press briefing regarding whether government intended to follow the lead of the UK and US who have both removed Covid entry tests.

“We have not. We still maintain that if you are unvaccinated, you will still be required to be tested,” Nicholas said.

He went on to say that the high rate of tourists still coming into the country, and the current low number of hospitalisations, is proof that the policy is working and thus there is no need to change it.

“I think our policy is one that is holding up and there has certainly been no negative impact of the number of tourists arrived here.

“Even yesterday, the Minister of Tourism did indicate that the tourism season has been very lengthy this year. We have monitored our policies and kept our border entry policies in relation to Covid, we have kept an eye on our major industry, tourism. We think we have managed that and have the results to show,” Nicholas added.

Effective April 13 this year, all persons entering Antigua and Barbuda have been allowed to do so without showing proof of vaccination – a policy that was already in place for returning nationals.

However, unjabbed persons are required to show a negative Covid test, taken no more than four days before boarding their flight to Antigua.

Two teens on trial for rape

Two young men are currently on trial in the High Court for raping a 15-year-old girl when they were just a year older than the alleged victim.

It is believed that in 2019 the complainant was at home with her three younger sisters when one of the defendants – a friend of hers who frequented her home – called and indicated that he was coming by.

The girl reportedly heard the voice of the second accused through the phone and immediately told her friend not to bring him to her house.

It is said that both boys still went to the house and she asked the unwelcomed boy to leave on several occasions.

He reportedly got upset and forced her into a bedroom where he pushed her onto the bed and raped her.

While in the act, it is alleged that her friend came in and also had non-consensual sex with her.

When her friend left, the first teen reportedly raped her again.

Soon after both of the young men left, the alleged victim’s friend reportedly messaged her and apologised. He also blamed the other accused for his actions.

The complainant reportedly told him that she did not wish to speak to him and then deleted the chat and blocked and deleted his number.

The young girl’s mother found out about the alleged incident when she came home to find her daughter in tears and breathing heavily.

The complainant reportedly collapsed into her mother’s arms, and the matter was reported to the police.

The jury trial which began earlier this week is expected to conclude on Monday.

Justice Ann-Marie Smith is presiding over the matter.

Cabinet is reaffirming its support to the family of Andre Simon who is in “dire” need of specialised medical attention abroad following a recent near fatal accident.

Minister of Information Melford Nicholas said Minister of Health Molwyn Joseph had highlighted the need to assist the national cyclist during Wednesday’s Cabinet meeting.

“We understand the risk involved and we have indicated to the Minister of Health to reach out to the family and to grant them the assurance that the government is prepared to help in a significant way to allow Mr Simon to get to that facility that has the opportunity to bring some restoration to his particular health,” Nicholas said.

Simon was one of four cyclists hit by a motorist during an early morning ride on May 8, but he was the only one in the group to suffer critical injuries and remained in the Intensive Care Unit (ICU) at the Sir Lester Bird Medical Centre until late last month.

The 36-year-old, who remains in the hospital, suffered head trauma and other internal injuries and was dependent on a ventilator for some time.

In the latest update provided by the cyclist’s brother Dwayne Simon, Andre is responsive to external stimuli and “seems to respond very well to his son, which is very interesting”.

“The help is forthcoming… and the resources have been committed to ensure that that can take place in very short order,” Minister Nicholas said further.

The family hosted a major concert over the weekend, netting EC$11,050, as they continue efforts to raise funds.

The fundraising efforts continue this week with a walk and ‘cyclathon’ slated for this Friday at 5.30am – a collaboration between the Irene B Williams Secondary, the All Saints Secondary, the Liberta Primary, the JT Ambrose Primary, and the Cobbs Cross Primary schools.

The family has also put up six vehicles for sale in the hopes of inching closer to the estimated US$500,000 needed for Simon’s medical care.

People can also make donations via the Caribbean Union Bank at account number – 20004089, the Community First Credit Union at account number – 098425, or the Eastern Caribbean Amalgamated Bank at account number – 131003564.

A GoFundMe account has been created towards the effort at the address https://gofund.me/49f11497 and has since raised more than US$54,000.

On May 18, Kenyatta Benjamin, 39, of Hatton, was charged with dangerous driving in relation to the incident. He was granted bailed and is due back in court on July 28.

CMC makes timely donation towards Andre Simon’s medical fund

The Central Marketing Corporation (CMC) has presented a cheque for EC$5,500 towards medical expenses for national cyclist, Andre Simon.

In making the donation to Andre’s sister, Beatrice Simon, the Chairman of the Central Marketing Corporation Board, Ambassador Clarence Pilgrim, said, “I would like to take this opportunity to offer our well wishes for a full recovery and ask that the family accept a token of our support in the form of a cheque, contributing to the medical expenses that are due”.

Ambassador Pilgrim also offered well wishes for Simon’s full recovery on behalf of the staff, management and board of directors.

He also took the opportunity to encourage other corporate citizens to join in the effort to help the national athlete who was badly injured in a May 8 road accident.

Clarevue staff lament lack of action to address their concerns

Staff at the Clarevue Psychiatric Hospital have become increasingly disgruntled with the perceived lack of action from the Ministry of Health to resolve several issues affecting them.

This discontent is certainly not new, considering many of the workers only recently returned to work after protesting the situation for more than four weeks.

They maintain that, along with being collectively owed more than EC$1 million in overtime and risk allowance, the infrastructure at the country’s lone psychiatric hospital is in a deplorable state and it is shameful that they are being expected to work as normal in those conditions.

Those members of staff who participated in the protest action returned to work last week, with the expectation that a meeting was to take place between the Health Ministry and the union representing them – the Antigua and Barbuda Public Service Association (ABPSA) – to determine the best way forward for all parties.

However, based on word from ABPSA President Joan Peters, that meeting did not take place.

“The Minister [of Health Molwyn Joseph] told us that we would have another meeting on the 15th, but when I checked, I realised that the 15th was falling on a Wednesday – a Cabinet meeting day – so I [figured] it would not have happened.

“I called [earlier] on Monday to find out when this meeting would [take place], I didn’t get any answer. I called again this morning [but was told] the Minister is not in his office as yet and the Permanent Secretary is busy. I left a message, but I haven’t gotten any word as yet,” Peters told Observer.

The labour relations veteran said the workers were not being unreasonable, despite the fact some of them have been owed money for nearly seven years, noting that the rise in inflation and other social pressures have made the circumstances dire.

What is adding to their displeasure, she said, is the failure of those in charge to live up to the simple promises made.

“[The Ministry of Health] said to give them an opportunity to do what they [need to do] and that’s why I [instructed] the workers to go back to work, so that they can’t say we are out there waiting on them.

“The workers have become agitated now, because nothing has been done since the last meeting that we had on the 25th or so of May,” she lamented.

Some of the workers started to receive the monies owed to them last month, and according to ministry officials, the disbursements would continue until everyone is paid in full. But with so much owed for so long, many of the staff are not confident their monies will be forthcoming anytime soon.

That has left a bitter taste in their mouths, according to sources, with an atmosphere of despair and disappointment clouding the facility.

“I don’t know what is going on … it is so frustrating for persons that they’re really not interested anymore,” Clarevue’s union representative Ava Bowen simply said.

Efforts to reach health officials for comment proved futile up to press time.

Youth advocates critique Cabinet’s stance on sex crimes involving children

Cabinet has come under fire for its attempt to address pervasive acts of sexual violence against minors.

Bus drivers were singled out in this week’s Cabinet notes for repeatedly breaching the Sexual Offences Act (2015), which stipulates that children under the age of 16 cannot consent to engaging in sexual activity.

Addison Browne, a bus driver, was convicted on Wednesday for tying up a minor and raping her after he was given the responsibility for taking her home in his private vehicle.

In response, Cabinet agreed for new measures to be put in place to ensure that predators face the harshest penalties provided by the law.

“Cabinet abhors violation of young children and will act to ensure that these violations come to an end and sexual predators against minors must face the severity of the law,” the notes further stated.

However, youth and gender advocate Zahra Airall argued that lack of enforcement of the laws regarding sexual offences against minors should be enforced and all abusers should face severe consequences.

“I don’t think the focus should just be on the bus men. The focus needs to be on all predators. From the politicians to the pastors, teachers, other workers and anyone else who comes into contact with children –their uncles and their aunts [too], because I think people tend to forget that women can be predators, too,” Airall said during an interview yesterday.

“What this can be a stepping ground for is an encouragement for everyone to stop concealing the family paedophile, for everyone not to turn to their Bible instead of reporting the pastor who molested their child, for persons to actually come forward when it is someone of influence or affluence who has interfered with a minor.”

Airall has long been advocating for the establishment of a sex offenders registry in Antigua and Barbuda.

She insists that proper mechanisms must be set to achieve the intended purpose and function of such a list in our society.

“This is something I have been asking about for over 10 years. I definitely support it. However, simply having a registry without consequence means nothing. So, again, it is enforcement of the laws because having your name on a list and people ignore it is not enough.

“We need to have the facilities in place to make sure that a sex offenders registry is impactful,” Airall added.

These issues remain recurring as several court cases involving the violation of minors have gone locally viral on social media in the past six months alone.

Cabinet spokesperson Melford Nicholas shed light on grooming of school children where they are lured by predators with promises of a relationship and flashy gifts.

“On observation, it was noted that some bus drivers have children below the age of consent that are in their vehicles for a very long time and they are going to and fro with them and are not allowing them to go to school.

“Or perhaps, maybe they would have groomed them to the position where they would accept gifts to make them available for the level of exploitation that they are doing,” Nicholas said.

Fellow youth and gender advocate Kadeem Joseph echoed sentiments similar to Airall’s, and made a suggestion to the Cabinet during Thursday morning’s press briefing.

“While I am happy that the Cabinet recognises the importance of strongly addressing the predatory behaviour towards children in Antigua and Barbuda, I believe that more needs to be done to address the pervasive culture of silence that we have surrounding these issues.

“We often see questionable and downright inappropriate behaviour involving children and there is just silence and often silence is viewed as tolerance. It’s also not just a bus driver issue, and young females are not the only targets of predatory behaviour,” Joseph recommended.

He further stated that beyond legislation, a strong message must be sent that Antiguans and Barbudans will not tolerate the violation of children, whether it be perpetrated by leaders or the common man, and it must be called out often, as “one child is too much”.

Talks underway with cruise lines to begin homeporting in A&B

Discussions are underway with major cruise lines to begin homeporting from Antigua and Barbuda.

That means the twin island nation could see some of the world’s largest passenger ships operating from here as their main base.

Tourism Minister Charles ‘Max’ Fernandez made the revelation during an exclusive interview with Observer.

Already, plans are in the works for one of the Carnival UK brands, P&O Cruises’ newest vessel Arvia, to begin homeporting in Antigua and Barbuda in 2023 and, according to Fernandez, there is a strong possibility that more cruise lines will follow suit.

“There are a couple other lines that are also speaking to GPH, Global Ports Holding, about homeporting. I can’t confirm anything at this time because they are still in discussions, but we are confident that it is going to be more than one looking to homeport,” Fernandez said.

“In addition to that, some of them are even looking to book now because they make bookings in advance and we are seeing an increase even for 2024.

“So, 2023 is going to be the start and what will really dictate how successful we are in attracting more lines is how those first ones are treated and their feedback.

“So, we are going to put whatever we can [in place] to ensure that everything is in place to make Antigua and Barbuda the most competitive for us in terms of homeporting,” he added.

It’s not the first time Antigua and Barbuda has been tipped to become a homeport. Plans had been in place for luxury cruise ship, Crystal Symphony of Crystal Cruises, to begin its voyages here from last August.

However, that never materialised after the cruise line ran into financial difficulties. It ceased operations in February this year.

Despite that loss, Fernandez indicated that homeporting will offer a number of benefits to the country.

“It is significant in that you will have people coming in by air and people going back out by air. You will have the whole movement of taxi drivers taking people from the port and back to the airport, so that is the first thing.

“Then, you have all of the taxes in terms of the airline travel as well, so there are benefits to it.

“In addition to that, once the ship homeports, we are told by the end of next year, the port will be able to offer power to the ships. We are also presently selling water to the ships.

“They have also indicated they may need to purchase provisions for the ships, so these are all opportunities for us with homeporting,” Fernandez explained.

The cruise industry adds millions to local coffers each year in taxes and expenditure but globally the sector became a poster child for the pandemic when countries across the world closed their borders in 2020 in a bid to contain the coronavirus.

Since then, the cruise sector has been on the rebound with significant returns to the island already.

Miscarriage survivor turned author offers advice for women and loved ones

Having a miscarriage is one of the most feared experiences for women hopeful of becoming mothers, but one survivor is hoping to lessen the burden on those suffering and their loved ones by telling her story.

Jihan Williams – a national of St Kitts and Nevis, an attorney, a social/development advocate and now an author – experienced a miscarriage herself, losing her son when she was six months pregnant.

While she understandably required time and support to overcome that personal trauma, she did not stop there, taking a step further to write a self-published book, titled, “Lifting the Weight of Miscarriage: Healing Insights on Pregnancy Loss for Sufferers and the People Around Us”.

Speaking on Observer AM earlier this week, she revealed several details about her ordeal, including the fact that she struggled to even conceive, before being faced with the worst possible reality.

“I was trying to get pregnant for four years, so having had that period of disappointment and then have it finally happen, you’re super excited.

“Everyone around me too was excited. I had an aunt in New York who was planning to come home for the first four months to help me take care of the baby, so I wouldn’t have to deal with that [alone],” she disclosed.

The pregnancy support advocate explained that putting pen to paper, speaking on her own experience, helped her to heal initially, before she realised it could do the same for others struggling to deal with such trauma.

“It was a difficult journey, but I started writing as my emotional outlet. I started doing that for myself, but then I started to have more experiences where it was clear to me that people around me didn’t know how to deal with me,” she said.

“They didn’t know what to say, they didn’t know what to do [and] there were things that were being said and done that were inappropriate to me, and the more I spoke with other women who had that experience, I realised there’s a universality behind this experience – yet so many people don’t know.

“Having to have those kinds of conversations numerous times, I realised that this is something that the public needs to hear about.”

If you ask family members or friends of a miscarriage sufferer, who have no prior experience with such occurrences, they will likely not know how to go about providing comfort, even though they will know it is definitely needed.

In those cases, persons tend to take the route of avoidance rather than confrontation, as a means of protecting their loved ones’ emotions.

According to Williams though, that is far from how someone who has suffered a miscarriage should be treated.

“People choose that option because they’re afraid to say the wrong thing, to trigger you or upset you, so they stay away. But people need to understand that staying away is actually more hurtful.

“I think the appropriate response is to acknowledge [the loss]. The thing that you don’t want to do is act like it didn’t happen. So, you don’t just go along your daily life dealing with [the mother] and don’t even acknowledge the fact that she’s in pain or that this loss happened.

“What I often tell people is…simply say ‘I’m so sorry for your loss [and] if you need me, I’m here – if there’s any way that I could possibly assist you during this time, let me know’, because it could be something as basic as bringing lunch or helping with chores, errands or something like that that eases the burden,” she explained.

She also highlighted, during the interview and in her book, the importance of acknowledging the hurt faced by fathers who share in miscarriages, again using her own situation as an example.

“There’s a whole chapter in the book called ‘The Forgotten Fathers’, because people seem to forget that fathers grieve too, and we had so many experiences where persons were reaching out to him asking how I was doing.

“Nobody was asking him how he was doing and it’s a huge oversight, because people seem to think men are rocks, they don’t feel and they don’t have any emotions. From my experience and other experiences that I’ve been able to observe as well, nothing could be further from the truth.

“So, we really have to give space for men to grieve and to heal from that process as well.”
