African operations contribute 50% to UBA’s earnings – CEO

The United Bank for Africa (UBA) Plc on Thursday announced that all its African subsidiaries are now on firm footing as they have been contributing maximally to the group’s profit margin.

The bank said its African operations, specifically, have contributed close to 50 per cent of the group’s earnings, leveraging on digital offerings and products across the board to gain large market shares across the different regions of operations in Africa.

The Executive Director/Chief Executive Officer of UBA Africa, Abiola Bawuah, disclosed this while addressing journalists from across Africa during a hybrid media parley on Thursday.

She also highlighted the impact of devaluation and double digit inflation in Nigeria and a number of other African countries where the bank operates, adding that the subsidiaries have been performing well, contributing significantly to the growth and development of trade, infrastructure and finance on the continent.

“As of last month, none of our African subsidiaries is making a loss. They have all been turning in profits, this is a testament to the fact that they have navigated successfully and have all found their footing.

“And this extends to each and every one of them, even the ones in war-torn countries. Of course, we are aware that there is always room for improvement, but for now, we are glad that our 19 subsidiaries are out of the red zone,” Mrs Bawuah said.

Infrastructure Financing

In the area of infrastructure financing, she noted that the bank has been bullish in financing projects across Africa, which according to her is based on the conviction that the continent needs to bridge the infrastructural gap necessary for economic growth.

“UBA has proven expertise and capacity in key sectors of economies across Africa, especially in oil and gas, infrastructure finance, agriculture and commodity/export, and these have positioned it as a preferred partner for structured solutions to key governments and corporates operating in/into Africa,” she said.

She noted that in the last few years, the bank has invested heavily and supported key governments of various African countries with over $1 billion in infrastructural development, especially in roads, hospitals, health, power and other critical sectors.

According to her, the bank has contributed massively in promoting trade in Africa and has partnered with the African Continental Free Trade Area (AfCFTA).

“At UBA, we believe that our customers should be able to trade conveniently among themselves, and so we have been partnering with them in this area.

“We have made it easy for our customers across countries to trade easily within themselves, without having to bother about all the hassles that have to do with forex,” she said.

Earlier in the year, Mrs Bawuah, a Ghanaian national, was appointed as the first female CEO of UBA Africa.

Her appointment, according to the bank, further demonstrates UBA’s commitment to diversity. The UBA Group Board now includes eight female Directors.

Before her appointment, Mrs Bawuah was Regional CEO, West Africa, supervising the Group’s operations in nine subsidiaries, including Benin, Burkina Faso, Côte d’Ivoire, Ghana, Guinea, Liberia, Mali, Senegal, and Sierra Leone.

The Federal Competition and Consumer Protection Commission on Tuesday said it will ensure that filling stations sell petroleum products in compliance with the law to prevent hardship on Nigerians.

The commission made this known Tuesday in a statement signed by Babatunde Irukera, the Executive Vice Chairman/Chief Executive Officer.

Nigerians have had difficulty getting petrol at filling stations since Monday after President Bola Tinubu announced government’s plan to put an end to the subsidy regime.

The government said subsidy payment will be scrapped because it is not sustainable.

PREMIUM TIMES reported how fuel queues returned to filling stations in major cities across the country, including Lagos and Abuja.

On Tuesday, Mr Irukera said that the commission has identified a “significant and potentially inexplicable emerging increase and lengthening of wait-times in procuring fuel at filling stations in certain locations across the country.”

The emerging hardship on motorists and other consumers, the statement said, invariably impedes commerce, traffic and presents other difficulties, unintended consequences and financial constraints for citizens.

The Commission said it is in engagement with the Lagos State Consumer Protection Agency (LASCOPA); the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA); and Major Oil Marketers Association of Nigeria (MOMAN).

“The outcome of these engagements between the top-level Executives of the Commission and these other relevant entities, as well as key operatives, demonstrates that, there is no operational basis or sufficiently diminished/acute reduction in product availability at both supply and retail points in the value chain to justify the hardship and constraints otherwise emerging,” the statement said.

“The Commission adopts the Advisory issued by NMDPRA on May 29, 2023, advising consumers not to engage in panic purchases or otherwise stockpiling products in a manner inconsistent with regular periodic purchases and consumption.

“Petroleum products are generally flammable and require transportation, dispensation, consumption and storage in strictly controlled and regulated manners. Any contrary approach to these strictly regulated manners constitutes danger and risk of significant losses, even fatality.

“As such, and in accordance with the assurances of the NMDPRA and MOMAN that existing supplies are not insufficient for regularly established consumption levels, the Commission encourages consumers not to modify their regular purchase and consumption patterns.”

Compliance

The statement stated that the Federal Competition and Consumer Protection Act, 2018 (FCCPA) prohibits deceptive or unconscionable business practices; obnoxious practices or unscrupulous exploitation of consumers by companies, trade associations, and even individuals; and any mutual understanding or decisions with a purpose or effect that prevents, restricts or distorts competition, specifically, and particularly including price-fixing or limiting distribution or supply.

It noted further that section 108 (1) prohibits any arrangements that unduly limit the production, transportation, storage and or supply of products, including for the purpose of enhancing price; while section 127 (1) prohibits supplying products at prices or on terms that are manifestly unfair, unreasonable or unjust.

“The Commission has today agreed with LASCOPA, (and its expanding participation) on a Joint Inter-Agency Task Force to enforce the provisions of the law, ensure compliance and prevent hardship on citizens,” the statement said.

“The Commission possesses the will and desire, and is committed to the strictest enforcement of the law. Product marketers have been informed that any infringement which distorts the market or enables others to exploit consumers and perpetuate inconvenience will be subject to the aggravated and highest spectrum of penalties where evidence supports violation.

“Organised marketing or trading associations/platforms such as MOMAN and the Independent Petroleum Marketers Association of Nigeria (IPMAN) are in particular invited to note this and their collective and individual possible exposure in the event of evidence-supported violations.”

The commission said it will continue to engage and update consumers, adding that Nigerians can also provide credible information about any conduct or practices they experience which they perceive to be a possible violation of the law.

“Such information may be sent through our normal channels, in particular, contact@fccpc.gov.ng,” the statement said.

Nigerian stocks jump at fastest pace in 2023 as investor confidence improves

Nigerian stocks accelerated at their swiftest pace so far this year on Tuesday as the main equity index rose by 5.2 per cent and the value of shares appreciated by over N1.5 trillion.

Analysts say the jump was helped by positive sentiments that followed new policy directions by the new administration in the country.

Investors warmed to President Bola Tinubu’s planned economic reforms, particularly his resolve to scrap costly fuel subsidies and unify Nigeria’s multiple exchange rates, with transaction volume increasing by 133 per cent and turnover more than doubling.

NGX 30, the index that measures the top 30 companies on the Nigerian Exchange in terms of liquidity and market capitalisation, expanded by 5.6 per cent. That was the sharpest growth rate since November 2020.

Unusual for the market, at least six stocks each added as much as 10 per cent, the highest daily upper price movement allowed by the bourse.

“We see more room for extended bargain hunting among listed corporates as investors look to reinvest dividends received across fundamentally sound stocks,” said analysts at United Capital in their outlook note for this week seen by PREMIUM TIMES.

“More risk-averse investors will look to book some profit off profitable positions,” they added.

Market breadth, an indicator of investor sentiment towards trade, was positive as 64 gainers were reported compared to 14 decliners.

The all-share index grew by 2,771.9 basis points to 55,738.4, while market capitalisation climbed to N30.3 trillion. Year to date, the index has yielded 8.8 per cent

Top Five Gainers

Zenith Bank appreciated by 10 per cent to close at N29.70. Transcorp Hotels enlarged by 10 per cent to end trade at N8.25. Nigerian Breweries rose to N42.35, notching up 10 per cent in the process. Jaiz Bank went up by 10 per cent to N1.10. FCMB completed the top 5, climbing by 10 per cent to N4.62.

Top Five Losers

Ikeja Hotel led losers, declining by 10 per cent to close at N2.16. NCR shed 9.8 per cent to end trade at N2.76. Tantalizers fell to N0.23, losing 8 per cent. Julius Berger slumped to N29, recording a 7.94 per cent depreciation. International Energy Insurance closed at N1.20, going down by 7 per cent.

Top Trades

Altogether, 1.1 billion shares estimated at N15.8 billion were traded in 9,916 deals.

Access Holdings was the most active stock with 199.6 million of its shares worth N2.4 billion traded in 963 deals. FBN Holdings’ shares of 127.9 million units, priced at N1.7 billion, exchanged hands in 213 transactions. Transcorp had 95.7 million shares valued at N309.2 million traded in 525 deals. UBA traded 24.9 million shares estimated at N831.5 million in 542 transactions. GTCO traded 76.4 million shares valued at N2.2 billion in 728 deals.

APC Primaries: How APC infringed on Timi Dakolo’s copyright – Lawyer

A prominent intellectual property rights lawyer, Rockson Igelige, has described the use of Timi Dakolo’s song at the recently held presidential primary election of the All Progressives Congress as an infringement of copyright laws.

The renowned lawyer made this statement during an exclusive interview with PREMIUM TIMES on Thursday.

Mr Igelige said the public use of an artist’s body of work without the artist’s permission is a copyright infringement, as stated in the Copyright act 2004.

The lawyer made this statement after Mr Dakolo called out the APC for using one of his songs during their national convention in Abuja on Tuesday, without asking for his consent.

Mr Dakolo’s hit song, ‘Great Nation,’ was played at the APC presidential primaries on Tuesday, when members of the Nigerian entertainment industry under the aegis of Ambassadors of Voice for Change appeared on stage to lend their voice to the call for peace and oneness in the country.

However, Dakolo took to Twitter on Wednesday morning to announce that he was not consulted before they played his song at the event.

The artist performed the same song during Atiku Abubakar’s declaration to run for the 2023 presidential election.

He wrote, “Why use an artist’s song without permission in a rally or campaign? The things people get away with in this country called Nigeria. It is the second time,”

Legal standpoint

Mr Igelige stated that before anyone could lay claims on copyright infringement, the person must show that they are the owner of the body of work and copyright subduce in it.

He said, “According to section one of the copyright act, subsection D, it is stated that to show that copyright subduces in a body of work, it must show that the work is original, and produced with sufficient effort by the originator and thirdly that the work is put into a fixed medium.”

He further added, “According to the provisions of the copyright rights act, it is a notorious fact that Timi Dakolo owns the song. It is also a notorious fact that he put in sufficient efforts in creating it, thereby establishing that originality.”

“It is also a notorious fact that the work is in a fixed medium,” Mr Igelige said.

The University of Westminster-trained entertainment lawyer based in Warri, Delta State said that APC infringed on the artist’s copyright by using his work without permission.

He said the purpose of copyright is to recognise the exceptional qualities of some individuals in society to protect them so they can create more.

Exceptions

According to Mr Igelige, some exceptions exist to exercise the copyright laws.

Using the instance of Dakolo, the intellectual property rights lawyer stated that one could use the artist’s work without his permission in some exceptional cases.

Some of the reasons he gave were, “First, for educational purposes, research, criticism or parody, and for news reporting, these are instances where you don’t give the artist permission before using a body of work.”

The lawyer further explained that some copyright laws exist as patents, trademarks, and trade secrets.

However, he maintained that the scenario of the APC convention does not fall under any exception.

“For the public performance of your work or to exhibit your career to the public, the organisers must seek the consent of the song’s owners. Therefore, the APC convention is a clear case of copyright infringement and a bridge on their intellectual property,” he said.

Regulations, Technicalities

Recently, Copyright infringement cases have continued to reoccur in the Nigerian entertainment scene.

Mr Igelige noted that there are organised bodies that regulate the copyright of Nigerian artists, such as the Copyright Society of Nigeria, COSON.

He said that COSON collects money from hotels or anywhere the public can access an artist’s work.

However, Mr Igelige said that not every lawyer has a business with copyright cases.

“If you are a lawyer unfamiliar with musical contracts, you have no business in a copyright infringement case.”

He said that lawyers with no ideas in musical contracts could not provide substantive evidence in court as it is not an area of specialisation.

Also, speaking on a recent copyright infringement case between Nigerian comedian Sabinus and UAC Foods and Friesland foods Nigeria plc, Mr Igelige said that due to a lack of professionals handling the case, the comedian and his team seem to be going off the record.

He said, “If there is no trademark registration certificate, there is no trademark infringement. Letter of acceptance from the trademark office does not indicate that the trademark is registered.”

In a legal notice dated May 25, 2022, Oga Sabinus’ lawyer demanded N100 million from UAC Foods for using an animated image of Oga Sabinus in an advert for the Gala sausage roll.

To drive a campaign on their social media page, the company posted an animation of Oga Sabinus on their Instagram page last Wednesday.

Responding to the UAC’s legal notice, Mr Igelige stated that image copyright issues are still foreign to Nigerian judiciary jurisdictions.

Often the popular saying, “age is just a number”, pops up when an older person is romantically involved with a younger person.

From time immemorial, men were the usual suspect in cradle snatching but in recent times, women are gradually closing rank with men, probably because women are more independent financially, which has given them leverage.

Some respondents in separate interviews with the News Agency of Nigeria (NAN) in Lagos on Sunday expressed divergent views on the idea of women dating and marrying men younger than them.

A baker, Anita Ebere, told NAN that there was nothing wrong with a woman dating or married to a man younger than her, as long as there was mutual respect.

According to Ms Ebere, she is currently dating a younger man and her relationship is in bliss.

“There is nothing wrong in dating a man younger if you are in love. I love my boyfriend who is four years younger than me, and we are getting married soon.

“As long as there’s mutual respect, I believe it’s no big deal. As a man, he is the head of our home, that’s not negotiable, as long as third parties are not privy to the information.

“Men, who are older than you tend to assert unnecessary authority over you, but younger men, are willing to hear you and carry you along in decision making,” she said.

Adeola Kolade, a fashion designer, said younger men had more energy and life span to satisfy older women sexually.

“Women are harder to satisfy sexually, some women with strong sexual appetites prefer younger men because they have the stamina to satisfy their sexual desires,” Ms Kolade said.

Priscilla Badmus, a fashion stylist and entrepreneur, told NAN that “love is not predictable, and women have their preferences.

“I prefer to date and marry an older man than marrying someone younger than me. I don’t have any reason. It’s just my taste; women who date younger men spend more in relationships, especially in Nigeria.

“However, if it happens that the young man has more money than the older woman, then many things will be compromised in the relationship, it’s all about preference.”

According to Stephen Odeyemi, a banker, dating a younger person irrespective of gender is a personal thing as long as the relationship is mutually beneficial.

“I don’t believe younger men date older women just because of money, there are lots of young men who love the peace of mind that comes with being with someone who’s mature and older.

“As I said, it depends on the two parties. For me, dating can work but marrying someone older than me, there are many risks involved like authority and money issues.

“A younger person will not feel intimidated by your authority; an older woman because of experience might want to drag leadership. It may not end up well,” he said.

Hassan Baker, a businessman, said that older women tend to be more understanding and patient in relationships.

“Younger ladies only seek sex, money and material things from men. But an older woman will plan along with you with maturity.

“I love being married to a woman older than me, satisfying a woman younger than me is something I can’t think of, younger women have a strong sexual appetite than a woman older than you.

“I didn’t love my wife initially, but I grew to love her because she was patient with me and also because of family pressure, I had to. They didn’t even know she was older. She had this sense of comportment.

“My wife spends more than me because she is the richer one. She doesn’t even bully me, and I don’t feel threatened in any way, financially or sexually,” he said.

John Ademuyiwa, a civil servant, told NAN that the economic situation of the country had made it difficult to understand some current trends.

“In the society, a lot of things are happening. You meet a very young handsome boy that is hopeful and can’t feed himself and you can give him money and befriend him, he will follow you, and I think it’s just the economy.

“The economy is doing a lot of things. It makes it easier for a young man who is supposed to meet a very young girl, to prefer an elderly woman.

“Older women will be like have you eaten today? Let me send some money to your account, she gives you relief and when the elderly woman is going to help you, the young one will be taking from him,” he said.

According to him, the woman may be serious about the relationship, but the young man cannot be.

“It’s very difficult to be committed to that kind of relationship. In the African setting, it’s actually difficult for a man to be naturally in love with a woman like that.

“Something is always attached to it, he collects the money and you give her the attention. But if you ask him to marry that kind of elderly woman, he will be ashamed.

“The older woman puts all of her heart in it but for the boys, they might still have their small small girls around,” Mr Ademuyiwa said.

Mr Ademuyiwa, however, said that it was easy for a young lady to fully fall in love with an older man than for a boy to truly be in love with an older woman.

“It’s easy for a girl to fall in love because the man will be very kind, take care of her, treat her like a queen, and always show that he wouldn’t beat her anyway. While her mates will beat her up, the man will not beat her.

“She might end up really wanting to marry him. It’s very possible for a younger girl to be in love with an elderly man,” he said.

On the possible effect of dysfunctional mummy issues, Mr Ademuyiwa told NAN that the absence of a mother figure should not trigger a young boy to have sexual relationships with an older woman.
